Terms and Conditions
1. About these terms
These terms cover all sales of refurbished climate control units and mail-in repair services by HusBen Industries (Ben Pennell, sole trader, Auckland, New Zealand). By buying from me or sending me a unit to repair, you agree to these terms.
If you're buying as a private individual in New Zealand, you have rights under the Consumer Guarantees Act 1993 that these terms can't take away.
If you're buying for business purposes, or if you're outside New Zealand, those consumer law protections don't apply and these terms are the full agreement between us.
2. Payment
For refurbished units, full payment is required before I ship your order. For repairs, payment is due once the repair is complete and before I return your unit.
All prices are in New Zealand Dollars (NZD) and include GST for NZ customers. International sales are GST-free — the price shown is the full amount you pay.
3. Shipping
I use tracked courier services that include insurance cover for items in transit. Your order is my responsibility until it's handed to the courier. Once it's with the courier, the shipping insurance covers loss or damage in transit.
If something goes wrong during delivery, get in touch and I'll provide the tracking details and shipping documentation to support your claim.
4. Sending a unit in for repair
When you send me a unit for repair:
You're responsible for packaging it well and shipping it to me safely. I'd recommend using a tracked courier service. I can't be responsible for damage or loss that happens on the way to me.
Once I receive it, I'll assess the unit and contact you with a diagnosis and price before I start any work. Nothing gets done without your go-ahead.
If the unit can't be repaired, or if you decide not to proceed after getting a quote, I'll let you know and return it to you. I won't charge you for work I couldn't complete. Return shipping back to you is at your cost.
If your unit is lost or damaged while it's on its way to me, you'll need to make a claim with your courier or insurer.
I reserve the right to decline a repair.
5. Warranty — refurbished units
All refurbished units come with a 12-month warranty from the date of delivery. If something goes wrong within that period, get in touch and I'll repair or replace the unit.
To make a warranty claim:
Email me at ben@husbenindustries.co.nz and describe the fault
I'll confirm whether you need to send the unit back
Ship it back to me securely using a tracked courier — you cover the cost of sending it to me
I'll cover the return shipping cost once it's fixed or replaced
The warranty doesn't cover:
Accidental damage, misuse, or neglect
Damage caused during installation, or by faulty vehicle wiring
Modifications or repairs carried out by someone else
Normal wear and tear
Water or liquid damage
Use outside the unit's intended purpose (climate control in compatible Mitsubishi vehicles)
Damage during shipping — contact your courier or insurer for that
Consumable items that wear out independently of my repair work, including button illumination bulbs (Evo I–III) and LCD backlight bulbs (Evo IV–VI)
6. Warranty — repair service
All repair work comes with a 12-month warranty from the date I return your unit. If the same fault comes back within that period, I'll fix it at no extra charge. The same process applies as above.
This warranty covers the specific fault I repaired. It doesn't cover new or unrelated faults, or anything caused by the exclusions listed in clause 5.
7. Returns
Sales are final once dispatched, except where:
The unit arrives not working — let me know within 7 days of delivery
A fault develops that's covered by the warranty
You have rights under NZ consumer law that apply
8. My liability
If something goes wrong, my responsibility is limited to repairing or replacing your unit. I'm not responsible for other costs that might flow from a problem with the unit — for example, transport costs while your car is off the road.
For NZ consumer sales, your rights under the Consumer Guarantees Act still apply.
9. My designs and processes
The custom designs and repair processes I've developed are my own. I reserve the right to commercialise them.
10. Governing law
These terms are governed by the laws of New Zealand.
11. Updates to these terms
I may update these terms from time to time. The current version is always at husbenindustries.com/terms. Changes apply to orders placed after the update date.
